Hi

Without naming any names ... here's what's happened.

I initially did my CBT with a bloke last year, and thought he was so good I referred 5 CBT's over to him (without comission :D). I since decided I wanted to do my full test before all of these EU directive rules come in!! I booked and passed my theory last week and decided that I'd book some lessons with the guy I used last year as he was great. I did 2hrs lessons with him last week and went on to book my mod1. I don't have a 125 and I wanted a bit of practice before the mod1, so decided to book a lesson before the test (this also meant I could use his bike for the test).

On Thursday I was at his house for 7am, as requested. The test was booked for quarter past 8. We set off to the test centre and pulled up on a very large car park to go through some maneuvers and I got to the swerve test + emergency stop part. I set off to get up to 50kph for the speedtrap (which is rather difficult on a YBR125 I must say :D) and accidently (and admittedly) crunched into second, and the chain snapped. He was extremely p*ssed off and started shouting (despite what I've done for him)! He pillion'ed me back home and there went my test. I did, however, still have to pay him his £80 (for the lesson and use of his bike for the test).

I'm rather pee'd off that he shouted at me dispite what I've done for him, and at the fact he's still charged me! I asked what I'd owe him next time (I don't see paying twice as being fair) and his response was "I'll see". I'm still a learner, so surely it's expected that I might accidently pop the clutch half way into second, or is that just me? Surely it was inevitable the chain was going to snap some point soon? I don't want to go back to him and want my £80 back. Can I do this under any grounds, I don't mind asking but would like to be able to turn around with grounds for my money back if he says no.

I would really appreciate any response here,

Many thanks,

Luke

I would let him calm down (yes, shouting at you is not good but hopefully it was a momentary lapse due to his bike being broken and a bill coming his way) His answer of 'We will see' tends to lead me to believe he had already started calming down.

Don't go in demanding, just see what he says when you go to see him next time, apologise for crunching into gear (although to be fair, you should not really be able to snap a chain by being a bit violent with the clutch) and see what he says.

If he then says 'you have to pay' then you have grounds to argue, odds on though he will just sort you out as long as you don't swagger in shouting the odds about your 'rights'

Thank you for your response, I really do appreciate it!

I do get on with him and see him a lot so what you said about it being momentary is probably true, I too would be pee'd off (breaking down 15 miles away from his home can't have been good for him), but as you say shouting isn't the right way of going about things.

I'll keep this up to date and let you know how it goes, although again I don't want to go back with him!

I would be looking at the maintenence on his learner bike as dropping into the wrong gear should not snap a chain!!

If the chain snapped it was knackered and would of snapped sometime soon regardless, poor maintenance on his part, nothing you did wrong!
