Ok, my step daughter has recently (about 14 days ago) purchased insurance for her bike and today is in a dispute with them over an alleged no fault claim that is apparantly registered on a CUE register and the result of which has increased her premium by a hundred pounds.


Now the problem is, my step daughter has never heard or made any claim fault or non fault and her previous insurers has no record of a claim either. This is a claim alleged to have been made against her in August 2015.


Her current insurer is asking for proof that she has not had a claim made against her - and they won't listen!


What is her best course of action please?

Ask them to provide details of the claim.. location, nature of the claim, vehicle regs involved etc.

If they can't prove it happened it didn't happen.

He certainly will, Hoggs. was hoping he'd see it and volunteer a solution rather than me hassling him directly. :D

asked that and they replied with 'unfortunately we do not have the details of the claim. You will need to contact your insurers at the time'.

And the previous insurer has confirmed there was no claim, so get that in writing, pass that letter to the new insurance company, problem solved!?

In theory, Joe. But the current insurer is adament that she has to prove that there wasnt a claim despite telling them that her previous insurer has not claim on file .. they just keep saying the CUE - whatever that is - says you have!

Spose that's possible. As far as the insurance companies look at things, she has made a claim on someone's insurance. Doesn't seem right though :?

No! ... She was a passenger in her sisters car ... only 16 at the time and it got hit by another driver giving her whiplash. She has just, October, got a pitence payout.


I think that she needs to challenge that. According to that link you sent me, if I claim on my home insurance they increase my bike insurance etc!

Apologies for not responding sooner, only just come online.


If your daughter was a passenger in another vehicle, that does not count as a claim against her. The claim will be recorded against the driver of the vehicle in which she was travelling, but even then, if she was rear ended, it is called strict liability and therefore deemed non fault.


Either way, even if she was the insured, the claim is made against the third party and is deemed a non fault claim.


Your daughter has not made a previous claim on any of her policies, and the fact that she made a personal injury claim has no bearing on anything the new insurers might suggest. They are just being too lazy or too thick to look into it properly.


In any case, a certificate of no claims can be provided by previous insurers which should be sufficient, and if they continue thos line, then refer the new insurers to the FSA at http://financial-ombudsman.org.uk/" onclick="window.open(this.href);return false;
