I got some quotes to fit a new (oil) boiler and cylinder a few months back and accepted a quote from a guy in my village. Mrs Fro asked the guy 4 or 5 times what the lead time for fitting would be and he said around a week to get the job completed as all he had to do was connect the boiler and cylinder and commission it (I've been installing new pipes/rad etc).Every time I've tried to contact him it's taken over a week to get a response. I spoke to him on Monday and was told he'd ordered the boiler and cylinder and that he'd drop them round by the end of the week. The end of the week is here and I have nothing - haven't even had a call! He also said that it would be three weeks to book it in but he might be able to squeeze it in around other jobs if he gets a delay on something else.Basically, I'm pissed off that he's dicking me about and I'm getting it in the neck from the other half because it's cold plus we're off on honeymoon in 3 weeks and I can't take the chance that it'll not be done by the time we go away. So the question is...Can I cancel the guy without any comeback even though he's supposedly already ordered the gear? No contract has been signed although I did send him an email accepting his quote but no money has changed hands. My back up plan is to order the gear myself, fit it and get the wife to sort the building control stuff, in which case I'll have it all done by next weekend.Bear in mind that this guy wants to charge me over 5k to supply and fit this stuff and it'll cost me around 2-2.5k to get it all on trade...Has anyone got any experience on this type of scenario?Cheers,Fro Quote
Fozzie Posted October 16, 2015 Posted October 16, 2015 He's given you false time scales and has not performed any services for you.You have every right to cancel.I'd ask Joeman as he's experienced with dealing with these kind of plebs. But from my point of view, no contract has been established, you were given a quote and a time scale from the sounds of it. The latter has not been met. If he claims you breached contract, you can claim he has breached it first if he wants the courts to decide. Keep all communication handy like e-mails and so on as you'll be amazed how lazy a contractor is until you turn down their custom. Then they seemingly have all the time in the world to take money off you via the courts. Quote
Joeman Posted October 16, 2015 Posted October 16, 2015 Supply of goods and services act states that you are entitled to expect services to be delivered in a reasonable amount of time. It helps if you give them a firm deadline and make "time of the essence". If they fail to deliver you are quite within your rights to terminate the contract on the grounds they have not delivered in a reasonable timescale. You can also sue them for breach of contract and costs incurred as a result of the delay... Quote
