papawads Posted July 24, 2024 Posted July 24, 2024 Was knocked off bike, broke bone in forearm in 5 pieces and now recovering from steel plate & pins surgery. Drivers insurance admit liability. Anyone been down this road? Any lessons to share? I'm choosing repair shop, asking for injury compensation, new helmet; expenses. Any pointers? Nearly 60 and first serious spill 1 Quote
cyberwolf Posted August 3, 2024 Posted August 3, 2024 If they ask you to go see a doctor or go for therapy don't refuse as it can effect your claim, also can claim back any traveling expenses (need receipts to claim) and cost of letters phones ect. And any lose of earnings. Quote
cyberwolf Posted August 3, 2024 Posted August 3, 2024 (edited) Also anything that's been effected in your day to day life can be claim for eg. Loss off sleep panic attacks the amount off pain you in, well up your claim as well. Edited August 3, 2024 by cyberwolf Quote
bonio Posted August 3, 2024 Posted August 3, 2024 No, not had to do this. But based on my latent level of cynicism, I'd say Keep receipts for everything you even might put in the claim. They will for sure ask you for them. Don't sign anything until you're sure what you're agreeing to. Don't believe the other party's insurers when they say things like, "it's for this, but don't worry you can claim it back" or "it's just to say you've understood what I've said". If it were me, I'd hire a solicitor - someone with experience of helping bikers like White Dalton - to handle the claim. 1 Quote

Nearly 60 and first serious spill Engage a motorcycle accident specalist solicitor. And do it now. I spent 18 months on crutches with much metalwork in my leg. Metalwork removed 12 months later.. NHS physio gave me a faded photocopy of exercises to do. They did not work. I was still limping badly. Solicitor sent me to a high end private physio who hooked me up to various electric shock machines and all sorts of moving tables twice a week. A month later I was back on my feet... The other party picked up the tab. Edited August 4, 2024 by Tinkicker 3 1 Quote
Pie man Posted August 4, 2024 Posted August 4, 2024 I've been knocked off twice, collateral damage. Chose your solicitor carefully, as above. 1 Quote

Nearly 60 and first serious spill I had exactly this in 2022. I was knocked off and other driver immediately admitted liability. It took 18 months to finalise. I regret using my insurance companies solicitor. The initial replacement bike and storing my bike was quick as they charge the 3rd party by the day for it. But settling my injury claim took forever. Getting updates from my barrister was like pulling teeth. In the end the insurance company got more from it than I did. As someone said above, ring white Dalton or similar to represent you. Never speak a word to the 3rd party or their solicitors. 1 1 Quote

Nice if they did admit it but as always doesnt matter if the driver or rider admitted liability, the view is from shock, gibber out through emotional state and not knowing law etc at the time of accident. coppers know this, so that’s the only reason they are very keen to chat as soon as possible especially to ask a few carefully chosen words of questioning to drop the subject in the shite before they clam up or think of a different scenario, obviously they know a regular or a trier with what reply they get. 21 hours ago, daveinlim said: In the end the insurance company got more from it than I did. the purpose, said it in one. replacement helmet and clothing in insurance policy is a con for most part and not what you think, if you read the small print it’s riddled with bs. You get a new helmet replacement? Nope it’s not an old for new or exact replacement it goes off percentage of age. Have a cheap arai £500 helmet (*wow you big spender thanks for the money but you dont need this policy and didn’t read it they think) it’s 3 or 4 years old they will say it’s near replacement but the value of it £100, thats all we’ll pay you so have to fork out the difference Even though it’s mandatory PPE. Clothing is essential but if they have to pay out they like to see it as not *. Their requirements is to put you back in the same place or position previously (their is a Latin word used but I can’t remember it) but with that train of thought you just end up worst off but their a shite load better .
