BECAUSE THE PRICK would have slowed down along side the biker just the very same as he spead up as he was to pass him . The moment it became apparent that he was racing (and was fast enough to cause a problem) I'd have indicated left and tucked back in behind him, even if it meant straddling the centre line momentarily whist waiting to be let in. That sounds a lot safer than what actually transpired.

Not sure if I'm missing something here, but given how you describe the damage then having it written off and subsequently buying it back for £350 sounds like a potentially sound move. You just need to get a repair estimate, or decide whether you're happy to ride it as is (assuming it's safe) as a cheap runaround.
